Job Summary
The Senior Manager – Legal is tasked with providing commercially relevant, practical, and proactive legal services to the Company. This role plays a crucial part in minimizing legal risks, ensuring compliance with regulations, and supporting the organization's strategic objectives through legal guidance.
Responsibilities
- Prepare, negotiate, and review legal agreements governing commercial relationships with third parties, including agreements for procuring services and goods, manufacturing and supply contracts, lease or leave and license agreements, distribution agreements, and other miscellaneous agreements.
- Manage and conduct litigation involving the Company, including various commercial, civil, and intellectual property matters; prepare cases for opinion, brief counsels, and attend court hearings while maintaining and updating the Management Information System (MIS) of legal cases.
- Oversee the management and protection of Trademarks in collaboration with the Corporate Intellectual Property Department at an international level.
- Provide strategic legal advice to minimize legal risks and maximize opportunities arising from new legislation in pharmaceutical regulatory matters, contract law, trade practices, intellectual property, property law, and corporate law.
- Handle correspondence with Regulatory and Governmental Authorities (e.g., FDA, DCGI, NPPA) to ensure compliance and facilitate timely responses in consultation with regulatory and quality teams.
- Offer legal support to the Distribution, Supply, and Logistics functions and manufacturing units, ensuring timely advice on contracts and day-to-day legal issues.
- Support the Clinical Trial functions and manage complaints from Consumer and Non-Governmental Organizations related to Company products.
- Advise stakeholders on compliance with local laws and regulations, implications under drug pricing laws, the Drugs and Cosmetics Act, pollution control laws, and other relevant legislations.
- Guide the compliance team on interpreting internal policies and applicable legal provisions and support global projects for new process implementations.
- Provide litigation and transactional support to the Business Development team, including assistance on acquisitions and disposals.
Qualifications
- Education: Degree in Law from a recognized University in India.
- Experience: At least 8-10 years of experience at a reputable law firm or as an in-house legal advisor in a large corporation with multiple locations, large sales, marketing base, and manufacturing facilities.
- Competencies:
- Robust knowledge of local law and regulations.
- Familiarity with local anti-bribery and privacy regulations; understanding of FCPA, UKBA, GDPR.
- Excellent written and verbal communication skills for conveying legal advice and documentation commercially.
- Sound judgment and strong business sense.
- Ability to evaluate and advise on legal ambiguities effectively.
- Proficient drafting and negotiation skills.
- Knowledge of privacy-related laws and procedures.
- Strong interpersonal skills to interact with a diverse range of stakeholders.
- Strategic thinking abilities with a strong customer focus, capable of providing independent advice.
- Knowledge of pharmaceutical laws and the healthcare industry is an advantage.
Preferred Skills
- Additional knowledge of healthcare regulations and compliance policies related to the pharmaceutical industry is preferred.
Experience
