Job Summary

As a Resolution Legal Associate Officer in the Resolution Department of our asset reconstruction company, you will play a vital role in managing the resolution of assigned legal aspects related to distressed assets and non-performing loans. Your primary responsibility will be to provide legal expertise and support in the resolution and recovery process, ensuring compliance with regulatory requirements and facilitating effective asset restructuring.

Responsibilities

  • Draft, review, and negotiate legal documents, contracts, and agreements related to asset resolution, restructuring, and recovery efforts.
  • Handle retail secured and unsecured portfolios, managing resolution under the SARFAESI Act, and monitoring collection agencies.
  • Coordinate with advocates/legal teams for issuing 138 notices and filing complaints under the Negotiable Instruments Act.
  • Initiate arbitration processes against defaulting borrowers and facilitate the execution of awards, including drafting applications and appeals under Sections 17 and 18 of the SARFAESI Act.
  • Manage vehicle repossession, including possession under the SARFAESI Act, yard management, skip tracing, and monitoring of collection agencies.
  • Draft and file writ petitions before the Bombay High Court and review notices issued under the relevant sections of the Act, providing replies as necessary.
  • Assist counsel before the Debts Recovery Tribunal and Debts Recovery Appellate Tribunal, conducting research and providing opinions to clients.
  • Collaborate with external legal counsel to handle legal proceedings, disputes, and litigation matters arising from asset resolution activities, ensuring compliance with the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act).

Qualifications

  • Bachelor’s degree in law (LLB) from a recognized institution (additional qualifications such as LLM would be an advantage).
  • Proven experience of 2 to 5 years in a relevant legal field.
  • Sound knowledge of laws governing financial transactions, banking regulations, insolvency and bankruptcy laws, and legal procedures.
  • Strong analytical skills and attention to detail, with the ability to interpret complex legal documents and agreements.
  • Excellent communication, negotiation, and interpersonal skills to interact effectively with internal teams and external parties.
  • Ability to work under pressure, meet deadlines, and adapt to a dynamic and challenging work environment.

Preferred Skills

  • Familiarity with asset reconstruction and recovery processes.
  • Understanding of compliance and regulatory frameworks in the financial sector.

Experience

2 to 5 years of relevant experience in legal roles, particularly in asset reconstruction and recovery.
